6. Intellectual Property Rights

All elements of the Site (including structure, text, photos, videos, data, graphics, logos, trademarks, and other reproduced elements) are protected by intellectual property rights, including copyright, neighboring rights, and trademark rights.

The Publisher grants users a free, non-transferable, non-exclusive, personal, and private license to use the Site strictly for personal purposes and in compliance with these TCU.

Unauthorized use of any part of the Site, particularly videos (e.g., piracy, counterfeiting, bypassing distribution restrictions), may result in legal action.

Users are expressly prohibited from systematically referencing any part of the Site’s content (videos, news, etc.), particularly through deep hyperlinks, to present the referenced content on other platforms or services for public or commercial purposes.

7. Objection to Text and Data Mining by Artificial Intelligence

The structure of this Website, as well as all audiovisual works and content available on the Website, together with all of their components (text, graphics, signs, signals, logos, sounds, music, images, videos, etc.), are protected by intellectual property laws and may not be used in any way without the prior written authorization of LTT.

Where necessary, LTT hereby expressly objects to any copying or digital reproduction of these audiovisual works, content and/or any of their components protected by copyright (text, graphics, videos, logos, metadata, databases, signs, signals, sounds, images, etc.) for the purposes of text and data mining, in particular by an artificial intelligence system (hereinafter “AI”), within the meaning of Articles L.122-5-3, III and L.211-3, 8° of the French Intellectual Property Code (hereinafter the “IPC”), transposing Directive (EU) 2019/790 of 17 April 2019 on copyright and related rights in the Digital Single Market.

Article R.122-28 of the IPC specifies that such objection “does not need to be justified and may be expressed by any means. In the case of content made available to the public online, this objection may in particular be expressed by means readable by machines, including metadata, and through the terms and conditions of use of a website or service.”
It is recalled that, in the course of its activities, LTT may authorize its contractual partners and/or online press services to use the audiovisual works, content and/or any of their components protected by copyright (text, graphics, signs, signals, sounds, images, etc.) available on the Website, strictly to the extent necessary for the authorized exploitation. However, such authorizations do not allow these contractual partners and/or online press services to make copies or digital reproductions of these works and/or content and/or their components for the purposes of text and data mining, nor to authorize a third party to do so, in particular an AI system.

Consequently, any operations involving text and data mining or harvesting (data mining, scraping, crawling, etc.), within the meaning of Article L.122-5-3 of the IPC, using the audiovisual works, content and/or any of their components protected by copyright (text, graphics, signs, signals, sounds, images, etc.) presented or made available to the public online on this Website or by third parties—whether such availability is partial or complete, free of charge or subject to payment—constitute acts of infringement, punishable under Articles L.331-1 et seq. of the IPC, unless prior written consent has been obtained from LTT.
The LTT Website may include a robots.txt file and, where applicable, <meta name="robots" /> tags, <TDM-RESERVATION: 1> tags, or TDM: NO tags in order to technically express our objection to text and data mining and harvesting operations. These tags must be respected. Any circumvention or failure to comply with these restrictions constitutes a violation of these Terms of Use.

The Publisher will make every effort to ensure the accessibility of the Site. However, access may be temporarily suspended for maintenance or updates without prior notice.

The Publisher provides no guarantees regarding interruptions or malfunctions caused by network congestion, unauthorized third-party intrusions, or potential viruses. While the Publisher strives to ensure the accuracy of information available on the Site, it cannot be held responsible for inaccuracies or user interpretations of this information.

Users indemnify the Publisher against any claims, actions, or liabilities resulting from their actions, including violations of these TCU or applicable regulations. This indemnification includes reasonable legal fees and damages.

9. Site Protection
Users are prohibited from using any hardware or software that could alter, interfere with, or distort the normal operation of the Site. This includes circumventing any usage restrictions defined by these TCU.

10. Limitation of Liability
Should the Publisher’s liability be engaged due to non-compliance with any obligations under these TCU, compensation will be limited to direct, personal, and certain damages, expressly excluding indirect or intangible damages such as financial losses, commercial losses, operational disruptions, or data loss.

11. Recommendations for International Users
The Publisher permits access to the Site from any country, provided local legislation and restrictions are respected. Users accessing the Site from outside France acknowledge understanding and accepting these TCU and agree to comply with local laws and restrictions.

Certain content may be inaccessible from specific regions ("Excluded Territories") due to licensing restrictions. Users located in these territories must not use systems to bypass geolocation measures.

12. Final Provisions
If any provision of these TCU is deemed unlawful, invalid, or unenforceable, it will be considered null and void without affecting the validity or enforceability of the remaining provisions. Such null provisions will be replaced by terms as closely aligned as possible with the original clause’s intent.
These TCU are governed by French law. Any disputes that cannot be resolved amicably will be submitted to the jurisdiction of the courts in Paris, France.
